Remedial Action and Enforcement

The powers to enforce the provisions of Section 34 of the Act and to take any remedial action necessary are set out in Section 36 - click here to view an extract of the Act.

Where a person fails to obtain a consent as required by Section 34 of the Act or fails to comply with the conditions attached to a consent, the Secretary of State has power to serve a notice requiring the works to be removed or altered within a specified period (not less than 30 days).  Failure to comply with such a notice within the specified period may lead to the Secretary of State arranging to remove or alter the works at the expense of the person responsible for the works.   In cases of urgency the Secretary of State may remove or alter the works without notice; again at the expense of the person responsible for them.

Any person found guilty of committing an offence under Section 36 of the Act, through not complying with the provisions of Section 34, shall be liable on summary conviction to a fine not exceeding level 3 on the standard scale.
